Metal-on-metal hip implants have saved millions of people from life-threatening hip disorders. Ever since it was first marketed in 2003, the ASR XL Acetabular System and the ASR Hip Resurfacing System, DePuy Orthopaedics’ own creations, have served over 93,000 Americans. When the unknown faults in the hip implants started to affect the patients, however, everything went haywire. Here and there, recipients of the defective implants threatened to file lawsuits. As an immediate defense, DePuy presented the victims with a reimbursement plan, promising to pay them back for all of their out-of-pocket expenses.

In your opinion, how will DePuy consider the worth of all the victims’ injuries?

The truth is, the reimbursement will not suffice. Before you even settle with this kind of nonsensicality, you have all the right to be aware of their goal to gather pertinent information from the victims—information which should never be shared to anyone in the first place. By the time you are persuaded to drop all charges against DePuy, and settle with their reimbursement claptrap instead, there is no turning back anymore. The moment you sign important documents regarding the reimbursement—vouching your agreement to be ‘compensated’—it might be difficult for you to file a lawsuit, which is quite disbelieving, since filing a lawsuit is actually the surest way for you to claim a just and fair compensation. They pledge to pay you with “reasonable and customary costs of testing and treatment” from the faulty hip implant, and yet they cannot even define the words “reasonable” and “customary” according to your situation. This is where it gets all odd and fishy—the reimbursement plan is nothing but a wise frontage to dupe the public into believing that they are concerned with the health of the victims, when in truth, they are only protecting their own sake.

The reimbursement plan by DePuy will only provide you with a small, unjustifiable amount of money. In filing a hip recall lawsuit, you can actually claim the fair amount of compensation that you are entitled to receive. You actually have a strong chance of winning the case, because many other victims are on the same boat as you are.
